BIER KÖNIG ARENAL, in its clear commitment to diligently and effectively address and remedy within the company any irregular or illegal conduct that may result in harmful consequences for the company, and in order to promote a culture of compliance and respect for the ethical principles and values of the company, has implemented an Internal Reporting System.

This system is designed to ensure easy access for our employees, suppliers, partners, and in general for any person directly or indirectly connected to the company, while guaranteeing:

  • Confidentiality.
  • Proper monitoring and processing of reported information.
  • Protection of the whistleblower, positioning this system as the company’s preferred reporting channel.

Reports must be submitted in good faith, in accordance with the provisions set out in the “Internal Reporting System Protocol.”
False, misleading, or unlawfully obtained information is explicitly excluded from protection.

Role of the Internal Reporting Officer

The Internal Reporting Officer is responsible for conducting investigations into potential irregularities and for assessing them in accordance with the “Internal Reporting System Protocol.” The Officer acts independently and autonomously at all times and guarantees to the persons concerned:

  • The confidentiality of all data and background information handled.
  • Thorough and objective analysis of any data.
  • Respect for the right to be heard and the presumption of innocence of any person concerned.
  • The absence of retaliation against any whistleblower or other cooperating person.
  • The adoption, where appropriate, of any necessary protective measures to ensure the whistleblower’s rights and enable the proper conduct of the investigation.

If you provide an email address when submitting your report, you will receive notifications regarding:

  • The progress of the investigation or the potential closure of the case.
  • Any other information related to your report, such as:
    • Requests for additional information or clarifications.
    • Notification of any change in the officer handling the investigation.

Submitting Reports via the Web Form

If you wish to submit a report via the designated online web form, you may do so:

  • Anonymously or
  • By identifying yourself.

Please note that if you choose to remain anonymous, we will not be able to contact you directly.
However, you will still be able to track the status of your report at any time using the unique code generated when your submission is made.

What is the Whistleblowing Channel?

The Whistleblowing Channel is a confidential communication tool that you can use to report conduct by individuals connected to the company that is, or appears to be, inappropriate or unlawful.

You do not need to be an employee of BIER KÖNIG ARENAL to use this system.
We encourage anyone who is able to inform us of any issue relating to the company to do so.

How can reports be submitted?

You can submit your report:

  1. In writing: by postal mail or via an approved electronic medium, specifically via a web-based reporting form. You will automatically receive a unique personal tracking code to monitor the status of your report.
  2. Orally: by calling 971743764 or via a voice messaging system.
  3. In person: by attending a face-to-face meeting in the office of the Internal Reporting Officer or at another specifically agreed location.

Am I required to identify myself?

No.
Although BIER KÖNIG ARENAL encourages transparency and trust so that you feel comfortable identifying yourself, you are under no obligation to do so.
You may choose to submit your report completely anonymously.

In either case (anonymous or identified), you will receive a personal key and password to access the “Report Tracking” section and monitor the progress of your report.

What types of situations can be reported?

Through the Internal Reporting System (and in accordance with its supporting Protocol), you may report, with full confidentiality and immunity:

  • Violations of European Union law, provided they relate to:
    • Public procurement (excluding procedures classified as secret or reserved),
    • Award of concessions or contracts,
    • Financial services, products, and markets,
    • Prevention of money laundering and terrorist financing,
    • Consumer protection,
    • Environment, nature, biodiversity, and climate,
    • Public health and the protection and welfare of animals,
    • Financial interests of the EU,
    • Internal market operations,
    • Competition, state aid, or taxation.
  • Conduct potentially constituting a criminal offense, such as:
    • Acts of corruption,
    • Fraud,
    • Favoritism.
  • Conduct potentially constituting an administrative offense.
  • Violations of labor law regarding health and safety at work.
  • Breaches of internal rules, protocols, procedures, or policies of BIER KÖNIG ARENAL.

When should a report be submitted?

We expect you to use our Internal Reporting System whenever you observe conduct or a situation that is illegal, irregular, or simply not right.

We can only correct issues if we are made aware of them.
For this reason, we strongly encourage your active participation in reporting any concerns.

Protection against retaliation and liability for false reports

The Whistleblowing Channel is intended for the confidential reporting of potential violations of the Code of Ethics or applicable laws.

Important:
Submitting or publicly disclosing knowingly false information is considered a very serious offense and is subject to fines ranging from EUR 30,001 to EUR 300,000 (Articles 63.1.f) and 65.1.a) of Law 2/2023).

Investigation and possible referral to authorities

The Internal Reporting Officer will conduct the investigation and evaluation of the reports.
If the conduct reported may constitute a criminal offense, the matter will be immediately reported to the Public Prosecutor or referred to another competent authority.

If the case concerns the financial interests of the European Union, it will be referred to the European Public Prosecutor’s Office.

If your report is not anonymous, your identity will be protected and may only be disclosed to the judicial authority, the Public Prosecutor, or the competent administrative authority within the framework of a criminal, disciplinary, or sanctioning investigation.

Using the Whistleblowing Channel

You may use the Whistleblowing Channel to:

  • Submit a report (with or without identification), or
  • Submit a general inquiry.

If you choose to remain anonymous, you will be able to monitor the progress of your report using the unique tracking ID provided at the end of the submission process.

Rights of whistleblowers and data protection

Both the whistleblower and the persons affected by a report are entitled to protection of their identity in accordance with Article 32 of Law 2/2023.

Furthermore, whistleblowers are granted a series of rights under Articles 2 and 35 of this law, including:

  • Prohibition of retaliation (Article 36), and
  • Support and protective measures against retaliation (Articles 37 and 38).
